Court heard that on Nov. 5, 2022, Henry left her toddler unattended in a bathtub filled with water while she cleaned her apartment wearing headphones. Mashiach, who was not yet walking, had no bath support or mat in the tub. Henry later found him submerged and called 911, telling dispatchers her son was turning blue and not breathing.

The court also heard that child welfare authorities had previously warned Henry twice about leaving her son unattended following earlier incidents in which he was injured but not seriously harmed.

According to The Toronto Star in delivering the sentence, Superior Court Justice Jane Kelly described Mashiach as extremely vulnerable and said he had been entirely dependent on his mother for protection. The judge became emotional while reading her decision, stating that the child’s death was preventable and represented the ultimate consequence of neglect.

Prosecutors had sought a four-year prison sentence, while the defence argued for a community-based sentence. The judge acknowledged Henry’s remorse, difficult upbringing, lack of criminal history, and efforts to rebuild her life, but concluded that jail time was necessary to denounce the conduct and deter similar tragedies.

Henry, who had been free on bail since her arrest, was taken into custody following the sentencing. In January 2026, she was sentenced to 3 years in prison for manslaughter.
