Timothy Shaun Nahmabin, 42 years of age, of Sarnia, was arrested on October 31st after turning himself in, and charged with second degree murder.

The charge against Nahmabin was reduced to manslaughter in February 2022. In October 2023, he pleaded not guilty to the charge.

Update May 22nd 2024: The trial heard that Court died of significant blunt-force trauma to her head and neck. Her death was initially ruled accidental by police.
A trial within a trial was held to determine the admissibility of some evidence, the judge ruled in January that Nahmabin’s charter rights had been violated. As a result, everything he said to police about allegedly harming his neighbour during a brief but key exchange in the lobby of police headquarters on Halloween 2020 was excluded as evidence.

Superior Court Justice Maria Carroccia she was not satisfied on the totality of the evidence the Crown had met its onus to prove the manslaughter charge beyond a reasonable doubt. “Accordingly, the accused will be found not guilty.”
